RENTAL AGREEMENT BETWEEN XXXXXX (RENTER) AND ALECIA ARMSTRONG (LESSOR)

RENTAL AGREEMENT & RELEASE OF LIABILITY KAYAKS, CANOES & RELATED WATER SPORTS EQUIPMENT

This agreement concerns the rental of non-motorized boats, canoes, kayaks, paddleboards, flotation devices and any other related watersport EQUIPMENT (hereinafter called EQUIPMENT) and is made between Alecia Armstrong, owner of Vermont Cottage in Plymouth, Vermont, its owners, sub-contractors, successors or assigns, hereinafter called “Lessor” and the undersigned, hereinafter called “Renter” who will be the responsible person on behalf of any group renting/staying at Vermont Cottage

This agreement also constitutes a Waiver & Release of Liability, and by signing this document, the Renter hereby acknowledges that they have fully read and understand/understood this agreement and understand that the use of the EQUIPMENT can be inherently dangerous and that serious injury and/or death could occur by its use. The Renter acknowledges that if any injury occurs to themselves or to a minor child for whom the Renter is the parent or guardian, then the Renter will make no claim against Lessor. Further, the Renter will hold Lessor free and harmless from any liability, claims, suits, or damages or whatever kind or nature that may be occasioned by the use of the EQUIPMENT and the Renter agrees to indemnify and hold Lessor harmless against all liability, to claims, suits, and expenses, including attorney fees incurred, arising out of any injury to any person, including the undersigned, and/or damage to any property by the Renter. The Renter named assumes full responsibility for this agreement.

INITIAL EACH ITEM BELOW TO INDICATE ACCEPTANCE OF THIS AGREEMENT

_____RECOGNITION OF RISK: RENTER EXPRESSLY ACKNOWLEDGES THAT KAYAKING, CANOEING, AND RELATED WATERSPORTS ARE ACTIVITIES WITH INHERENT RISKS OF INJURY TO PERSONS AND PROPERTY.  RENTER IS AWARE THAT THOSE RISKS AND FURTHER UNDERSTANDS THAT BY PARTICIPATING IN KAYAKING, CANOEING, AND RELATED WATERSPORTS THAT THEY ACCEPT THE DANGERS THAT INHERE THEREIN INSOFAR AS THOSE DANGERS ARE OBVIOUS AND NECESSARY. RENTER ACKNOWLEDGES THAT PERSONAL FLOTATION DEVICES (PFD) ARE MADE AVAILABLE AND THAT ALL RENTERS ARE REQUIRED TO WEAR PFD’S WHILE USING RENTAL BOATS AND EQUIPMENT. RENTER UNDERSTANDS THAT USE OF PFD DOES NOT REMOVE ALL RISKS OF INJURY; NOR DOES A PFD’S USE MAKE KAYAKING, CANOEING OR RELATED WATER SPORTS SAFE ACTIVITIES. RENTER ALONE HAS DETERMINED THE SUFFICIENCY OAF ANY SAFETY GEAR OR OTHER PRECAUTIONS THAT RENTER DECIDES TO TAKE TO MINIMIZE THE RISKS OF THE ACTIVITY. RENTER EXPRESSLY ASSUMES THE RISKS OF THE ACTIVITY

_____RENTER SHALL OBEY ALL APPLICABLE LAWS AND REGULATIONS WHILE UTILIZING THE EQUIPMENT

_____RENTER IS SOLELY RESPONSIBLE FOR ANY CITATION OR LEGAL VIOLATION INCURRED BY RENTERS USE OF USE OF OR RESULT OF USE OF  THE EQUIPMENT.

_____RENTER ACKNOWLEDGES THAT THEY HAVE HAD AN OPPORTUNITY TO INSPECT THE EQUIPMENT AND FIND IT IN GOOD WORKING ORDER, CONDITION, AND REPAIR.

_____RENTER REPRESENTS TO LESSOR THAT THEY HAVE ADEQUATE SKILLS, KNOWLEDGE AND EXPERIENCE TO SAFELY USE, OPERATE, HANDLE, AND UTILIZE THE EQUIPMENT.

_____RENTER BEARS ALL RISKS AND RESPONSIBILITY OF AND FOR ANY AND ALL DAMAGES, LOSS OR THEFT OF THE EQUIPMENT, AND SHALL PAY LESSOR THE FULL COST OF REPAIR OR REPLACEMENT.

_____RENTER SHALL RETURN THE EQUIPMENT IN THE SAME CONDITION IN WHICH IT WAS RECEIVED. LESSOR RESERVES THE RIGHT TO CHARGE FOR REPAIRS AND CLEANING IN THE EVENT THE EQUIPMENT REQUIRES REPAIR OR EXCESSIVE CLEANING AS A RESULT OF RENTER’S USE OF THE EQUIPMENT. ALL WATER IS TO BE REMOVED FROM EQUIPMENT BY RENTER, BEFORE RETURNING TO LESSOR.

_____RENTER AGREES TO USE ALL EQUIPMENT ONLY FOR ITS DESIGNATED PURPOSE.

_____IF BOATS ARE LEFT BEFORE OR RENTER’S YOUR CONTRACTED TIME, RENTER AGREES TO NOT USE BOATS BEFORE OR AFTER CONTRACTED TIME. 

_____IF OTHER BOATS ARE ON PROPERTY AND NOT LOCKED UP, RENTER AGREES TO NOT USE THOSE BOATS WHICH HAVE NOT BEEN RENTED. 

_____THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN LESSOR AND RENTER AND NO TERM MAY BE WAIVED OR MODIFIED EXCEPT IN WRITING SIGNED BY BOTH PARTIES. THERE ARE NO WARRANTIES, EXPRESSED OR IMPLIED, BY LESSOR TO RENTER, EXCEPT AS CONTAINED HEREIN, AND LESSOR SHALL NOT BE LIABLE FOR ANY LOSS OR INJURY TO RENTER NOR TO ANYONE ELSE, OF ANY KIND OR HOWEVER CAUSED. THE LAWS OF THE STATE OF VERMONT SHALL GOVEN THIS AGREEMENT.
