Rental Agreement, House Rules, Release of Liability: One hundred percent of rental rate, turnover clean fee, refundable damage deposit, applicable lodging taxes, must be received to confirm reservation. Number of guests allowed: 6 Lake Access: Our property has a lake view, but does not have lake access. DO NOT attempt to access the lake near our property. All of the lake access nearby is privately owned and you will be trespassing. The closest authorized lake access is the Tellico Village Family Park at Tugaloo Drive. This is a 5 minute drive, 2.9 miles from the property. There are also a couple boat launches within Tellico Village. Animal/Pet Policy: No animals/pets allowed. This is a animal/pet-free property due to owner’s allergies. If a pet/animal is brought into our property, there will be an additional $1000 cleaning fee, AND your remaining stay will be cancelled with no refunds. Smoking Policy: No smoking on the property of ANY kind (including vaping). Any smoking on property will be an additional $1000 cleaning fee, AND your remaining stay will be cancelled with no refunds. Parking Policy: Please park in the driveway. Do not park on the street or in the grass. No RV’s or Camping allowed. No oversized vehicles unless approved by owner prior to arrival. Minimum age to book is 25. Construction is a daily occurrence in the Village. While there are quiet hours 9pm-7am, we cannot guarantee there won't be other noises around Tellico Village. Visitor Policy: Any day/night visitors must be approved by owner, and maximum number of guest/visitors combined is six persons (this includes infants and children). Additional overnight guest/visitors are $40 each per day (up to max occupancy of 8). Camera’s and Internet Policy: We have 3 camera’s on the property, one at the front (Ring Doorbell), one by the garage (Floodlight Camera), and one in the back yard. All camera's are motion activated and record both voice and video. The camera's are for our property’s security. Any tampering or disabling of the camera’s are grounds for immediate removal of all guests from the property (forfeiting all funds). High speed Internet is provided for your use as well as connectivity of various “smart home” devices throughout the house (thermostats, alarms, camera’s etc.). Any tampering with the Modem/Router or other plugged in devices will be grounds for removal of guests from the property (forfeiting all funds). Cancellation Policy: Cancellation policy is NO refunds. Once dates are taken off the market, they become unavailable to other renters. With owner approval, guest may find a replacement renter or gift their dates (not future dates) to someone else. Guest MUST cancel the original reservation before owner will assist in trying to rebook the dates. Trip Cancellation/Interruption Insurance: It is highly recommended guest purchase trip cancellation/interruption insurance in case of family emergencies/bad weather delays, flight/rental car cancellations, job loss, snow/ice, Covid-19 bans/restrictions, etc. If you live in an area prone to hurricanes, forest fires, etc. and cannot make your trip, please seek reimbursement through your travel insurance. NO refunds are given unless there is a mandatory evacuation in our area. Please check what travel insurance your credit card may offer. You can also visit (Website hidden by Airbnb) Release of Liability: IN CONSIDERATION for being permitted to enter premises and property for our vacation rental or any other purpose, the undersigned, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgment that he/she has inspected house, deck and entire property and he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately leave the area and advise appropriate persons. THE UNDERSIGNED hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO (Website hidden by Airbnb) personally and as company or corporate representatives, their members, managers, operators, officials, officers, directors, employees, owners and lessees of the premises, all for the purposes herein referred to as “releasees”, from all liability to the undersigned, guests, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of INJURY to the person(s) or property or resulting in DEATH of the undersigned or guests, whether caused by negligence of the releasees or otherwise while in or upon the area. THE UNDERSIGNED hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releasees or otherwise. Dishwasher: Careful: please! This machine is dangerous for children. Any damages or injury caused by our dishwasher is your responsibility. It is the renter's responsibility to make sure USDA approved chemicals are used for washing the dishes. Disorders or chemical skin imbalances are not covered by our insurance. Please make sure you use the approved soaps. Toilets: Clogged toilets are not fun. Please do not use too much paper, ONLY flush toilet paper, no feminine products. In case the toilets get clogged, make sure you fix it yourself. Smells can create adverse brain/taste and nose diseases causing permanent damage to your body. There is a plunger provided in the Laundry Closet. Showers and or bathtubs: Showers and bathtubs can be slippery. You are taking full responsibility for yourself and your guests on our premises with regard to showering and tubbing. Please make sure your insurance company covers this. Slipping: Breaking your neck or any other part of your body is your responsibility. The same for your guests, family, friends etc. You will not hold us liable for accidents. THE UNDERSIGNED hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of the releasees or otherwise while in or upon area. THE UNDERSIGNED hereby certifies that he/she and guests (they) have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. The undersigned further agrees that he/she/they have no medical conditions which would interfere with use of dishwasher, toilets, showers/bathtubs and or electric fireplaces and dangerous activities like hiking, rock climbing, climbing stairs, etc. or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage. The undersigned further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Any dispute, controversy or claim arising out of or related to this Agreement or the interpretation of this Agreement shall be settled by arbitration in accordance to the rules of the American Arbitration Association, except to the extent modified below. The place of arbitration shall be Loudon County, TN. THE UNDERSIGNED HAS READ, UNDERSTANDS THE RISKS, AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILTY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made. Bugs and pests: The property is in Tennessee. Although we have a regular pest control service, we cannot guarantee it to be pest free of all bugs and animals. We cannot compensate for the presence of pests, insects and animals. We also ask that all guests respect nature that you Do Not feed wildlife. Videography/Photos: While we encourage guests to take lots of pics/video of your vacation while at the property, any professional or "for profit" video/photos of or at our property is strictly forbidden (unless authorized before arrival by owners). Business transactions: Any operating of or otherwise doing business (that will bring any traffic to the property) is forbidden and will be grounds for immediate removal from the property without refund. Shipping/deliveries: Having items shipped to the property is not allowed (unless authorized by Owner prior to the shipment). Forgotten items upon departure: Any personal effects that are left at the property will be disposed of by the cleaning crew. We are not responsible for any items left behind. If it is something of value and the cleaning crew brings it to our attention, we will attempt to contact you to return. Any returns of items will be at the guests expense as well as incur a minimum $50 processing/transportation fee. No guarantees your items will be returned. Code of conduct rules must be followed by all guests: Inappropriate conduct /behavior includes but is not limited to violence, verbal or physical abuse, violating all part of this said agreement, act or acts that threaten the safety to others, loud music, repetitive noise that disturbs others, annoying to others or unauthorized services, programs or gatherings. Guests will be asked to leave and no refunds will be given. Guest agrees to abide by information in this agreement and in the arrival guidebook, and shall cause all members of the rental party (anyone else Guest permits on the property) to abide by them as well. The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below.
